forcing sale of property

I am divorced and my ex wife took me to the final hearing regarding the financial settlement. The court ordered her no maintenance payment but payments for the children, a share of pension and the proceeds from the matrimonial home. It is now three years since we separated and two since divorced.The mortgage on the house is in joint names. The court ordered the sale of the property under joint instruction.We agreed an initial valuation and she chose the estate agent.She subsequently wouldn't drop the value of the house(as recommended by the estate agent) so I took her back to court a number of times where eventually the price was dropped but she insisted on changing estate agents because she blamed them for the failure to sell the house. The new estate agent has received an offer for the property which they believe is a good offer considering the current market etc but my ex wife is refusing the offer and insisting on full asking price.The last time I went to court to drop the house value I acted for myself in court and the the general form of order stated.."the application is adjourned generally with liberty to restore on no less than 7 days notice to the respondent"How can I quickly go back to court to get the court to consider the offer that my ex wife will not accept. At the final hearing of my original sttelement it was ordered that "the house shall be sold on joint instruction to the parties by an agreed estate agent between the parties for a price to be agreed by the parties or in default by the court" I need to get her to sell the proerty so I can get off the mortgage and start to get back on the housing ladder. I have rented for three years.I do not believe she wants to sell the house or release me from the mortgage. She could not have the mortgage in her right. She pays the mortgage with the child maintenance that I pay her.Any advice please?

I too was in the situation of having a STBX (he living in the property) and refusing to co-operate with the sale and had to get court orders all the way along the line to force the sale through - very trying indeed. I had re-possession threats too, so my case was a bit different, but you have orders already, so suggest you just keep building on these.

I recall I requested an emergency next day hearing from the to set a date for a longer hearing,(I recall a week later) to serve STBX with the necessary order and time to respond.

Suggest you ask yourself what's behind her lack of co-operation as this could have a bearing on the outcome. Is it laziness (she may have probs justifying this in court) or a genuine lack of finance or bad credit rating which will make it hard for her to re-house herself? You may not know the answer to this, but it may be worth asking if you communicate.
