I too was in the situation of having a STBX (he living in the property) and
refusing to co-operate with the sale and had to get court orders all the
way along the line to force the sale through - very trying indeed. I had
re-possession threats too, so my case was a bit different, but you have
orders already, so suggest you just keep building on these.
I
recall I requested an emergency next day hearing from the to set a date for
a longer hearing,(I recall a week later) to serve STBX with the necessary
order and time to respond.
Suggest you ask yourself what's
behind her lack of co-operation as this could have a bearing on the
outcome. Is it laziness (she may have probs justifying this in court) or a
genuine lack of finance or bad credit rating which will make it hard for
her to re-house herself? You may not know the answer to this, but it may be
worth asking if you communicate.
