CETV - Provider Charges 3 Years, 8 Months ago
|
|
I have asked the Armed Forces Pension Scheme to provide a CETV. They
instead provided a valuation as to the current value of my pension
rights.
They also stated that should I want a CETV then I would
be charged from what I can make out from the booklet £150 plus VAT as there
is an additional charge to the tax payer for this service which they expect
the member to pay and not the tax payer, which is I suppose fair.
Am I expected to pay this fee to provide the CETV or can I agree to my
stbx solicitors applying and let them pay the fee? I am divorcing her, I
dont see why I should pay, as I am already paying the Court Fees too!

Hi DJPS,
Your stbx is entitled to ask for the CETV of your
pension. It is your pension - your solicitor or yourself have to ask
the pension scheme to provide a CETV. The best you can hope for is
that the relatively modest fee can be paid for by both of you.
You are saying that you are divorcing her. The petitioner pays the court
fees. Full stop.

you can usually request one CETV in any 12 month period.
if you
ask for another inside the twelve months then the schemes can, and usually
do charge a fee.
the fees are usually disclosed up front, and
there are also guides laid down by the NAPF (National Association of
Pension Funds), however these are only guides.

Thanks to both for your responses.
The petitioner can also ask
for the costs to be shared or paid for by the respondant, and I can,
according to my pension provider grant authority for her to apply for a
CETV, and as for the fee, modest (in your opinion) is still money I resent
paying out when I am divorcing her !
If there is no presecedent
than I am more than happy to set one!
My pension provider has
supplied a valuation, which is the one free service allowed per 12 months.
I believe from reading on this site that this valuation would not be
sufficient for a Form E but would it be sufficient for a D81?

If you have a free valuation (CETV) from your pension provider, then that
is sufficient for form E. These are sometimes challenged by the other side
but then they would have to pay for an actuarial report, or the court may
order you both to share the fee...

The issue is they provided an evaluation and not a CETV, there appears to
be a difference!

Sorry - suffering end of day brain fog... they should still provide you
with one free cetv a year - maybe they were being bloody minded and need to
be asked specifically using the term cetv.... or maybe you did that, in
which case I apologise and will shut up now!
