Re:Does the CSA include working & child Tax credits?

My s2bx has approached the CSA for maintanence for our 18 year old who lives with him.

Whilst I dont have an actual issue with this, the CSA contact me and informed me that they also include my Working & Child Tax Credit within there calculations on top of my low salary, which seems rather unfair?

Can anyone clarifiy this. Im awaiting for the corresponce to this claim!!

Afraid it is total income after tax ni and pension that is taken into account.

YOu say your son is 18. If he is still at college you have to pay until his 19th birthday. If he is not at college you don.t have to pay anything.

I am confused. Are there other children involved or are the child tax credits for the 18 year old?

The non resident parent's WFTC are considered income for CSA purposes. See Part IV, Child Support (Maintenance Calculations and Special Cases) Regulations 2000;

sillywoman...yes his still at college but the course finishes in July as far as I know.

James53....unfortuately the family are divided, one child each, i received W & CTC solely for the dependent that is with me. Its an awfully sad situation that neither side have any contact with each other apart from my DD has minimal communication with her sibling.

Thank you Fiona can I use this evidence in court as at my FH for AR yesterday I informed the judge what the CSA had told me and she laughed and said they get it so wrong sometimes and the figure I was quoted should be half. I have looked a the document but it states "working families Tax Credit", I receive both working and Child Tax Credits. Does this apply to the Child part as well?

Unfortunately, the judge increased my monthly income back up again.

Any ideas...in repsect of the FH no decision was made as the judge has made an order for pension info, so I can hopefully send her a letter and inform her of my findings. Or do i just have to accept that she was wrong??

Yes it applies to CTC and WTC as you will be on CS2 if its a new application.

Do you earn a lot more than your ex? how old is the daughter that lives with you?

No i earn much less than him Wyspecial our gross figures are me £9700pa him £40,000pa approx. (these are gross figures). Our daughter is 15 who lives with me. I also received CSA payments from him for our daughter, which the CSA told are not included.

Does anyone no whether its worth writing to the Judge with my evidence or do I just accept it that she's wrong.
