The only way her income would be taken into account is via working tax
credit so your friend has given you incorrect info. CM is paid at flat rate
£5 week for cm as per the csa if out of work or claming
benefits as the nrp. i know as
i have been on jsa in the past and this is what the csa ordered me to pay.
my partner, who i cohab with honestly and openly, has never had her income
mentioned or questioned at any point for
child maintenance or for divorce proceedings, which is
the way it should be. she does contribute half the bills and half the
mortgage, and thats it as far as she and i are concerned, why should she
pay for my ex wifes upkeep whilst she has earnt and worked for her own
money herself? because i choose to live with her?
what if they
split up?
what if you ended up with someone who had a child they paid
maintenance for? would you think it fair if your wages or income were taken
into account for that child?
cohab is very hard to prove, but
saying that as i have stated above her income would only be taken into
account so far as the courts were concerned...that she should be
contributing half of the household bills. her income cant be used to
support you or your children.
whilst it can be a bitter pill to
swallow knowing their household income is higher, the only thing you can
really take into account is your ex's income and your marital assets.
