Can I ask you one or two things.
The most important is this. You
say the order is due to expire in 2 years time. Is there a bar on applying
for an extension ?
From what you say I suspect she may well be
entitled to apply for an extension. But it might be important to know.
In general it is not all that easy to get a term order extended
because the Court that made the original order obviously thought that she
could become self sufficient by the time the order expired ( otherwise they
should not have imposed a term order at all ) and it rather sounds from
what you say that she is self sufficient.
The risk - from the
point of view of both parties - is that the Court will look at the whole
situation afresh. If you have prospered mightily the Court may say you
should be paying more, so the sum needed to buy it out would be greater.
On the other hand the Court might say she is self sufficient
and impose an immediate
clean break with no compensation.
There is
also a risk that any attempt by you to buy her out would simply lead to an
application for an extension. But this carries risks for her too, as I
tried to point out.
If you can google the case of Pearce v
Pearce you may have a better idea as to the broad principles behind
variations.
