Hi,

Can anyone help me. I am going through a divorce with my ex and to date, I have managed to do most things myself. However the financial side is now close and I need help.

Whilst I earn a reasonable salary, after paying for our children, mortgage, rent to live, money for children, money to repay debts incurred in the marriage, I have no money to pay for a solicitor.

I have looked at legal aid, but I am excluded from help as I earn over the limit. However, it does not take into account that I have to pay back out most of my salary, so have nothing to get advice.

Whilst I am happy to pay what is fair and have offered the house and contents, I am concerned that I will end up with a court order that means that I will not be able to even afford food.

Is there anything that can help me?

Mediation to arrive at an agreement is worth considering. Otherwise, assuming you own your own property, a good starting point is to gather information about local house prices and ascertain both parties' mortgage raising capabilities. Once living arrangements for the children have been determined it is then a case of working out if one of you can afford mortgage payments to remain in the former matrimonial home or if the property is bigger than required whether it could be sold to release equity which could be used to purchase two homes. Alternatively it is possible to defer the house sale until the youngest child reaches 18 or finishes tertiary education.

The aim is to leave both parties on a similar footing not a mathematical split. For example, a parent with the majority of care of children will require a larger property and if they have lower/no earnings they will not be able to raise the same amount of mortgage as a higher paid spouse. Therefore the PWC/lower income spouse would need a larger share of capital to leave them in the same position as the higher earner.
