Re:Court made a mistake - not sure what to do.

The LSC date stamp all applications once received, yes they can be painfully slow but you should be on the system certainly after months and the fact you have had some funding for mediation, so i`m not really sure what your solicitor means?.

Still don`t agree naming the co respondent is a good idea, it almost always causes problems (as it has for you) was it your idea or the solicitors?, even the notes for lay persons on D8 say you don`t need to name the co respondent, a good solicitor will work hard to save time money and stress and keep the divorce as amicable as possible.

I asked for co respondent to be named at my first appt with solicitor nearly a year ago, nothing was said at the time. It has delayed things as the court forgot to send her the divorce petition etc. I have since found out that this is unusual, however am quite happy for her to be named - she laughed in my face and told me she thought it was funny she had split me and my husband up and made my children unhappy, she also went on to say she would make sure my children would be unhappy with her when she saw them with stbx - which has now meant that contact arrangements are difficult because of her beahviour - stbx has chosen her over seeing the children.
Hopefully it will all be sorted out soon.
Stbx had no problem with her being named on petition, she has no problem with it either - just court and solicitors messed up.
I'm just fed up with the whole thing now, I just want a settlement sorted out and to get on with my life - after all he has got on with his (moved her into fmh 3 months after I left fmh - me to live in a much smaller house with the children because he had originally bought the house not me and I thought it was fairer - although if I had known then what he was up to I wouldn't have left!).
The stress of it all, having to constantly be on the phone trying to get through to benefits agency, council etc etc are making me ill, on top of this I now have to sign on at the jobcentre every 2 weeks to get any money - as youngest child is ten. Don't get me wrong I don't expect something for nothing but when together with stbx I was a stay at home mum - both our choices as he has a high income, I now have nothing much to live on while he is happily carrying on like nothing has happened! and because the divore is taking so long none of the ancillary relief has been sorted out so he isn't paying spouse maintenance yet either.
Sorry to moan, just needed to get it off my chest.
