Re:Police involvement

Hi to all,

I was wondering if anyone could advise; I have tried to recover some important documents from the FMH. I've asked three times, twice via Solicitors but vindictive ex has ignored. I consulted Police who said if I had no joy they would take up as a criminal matter (because one thing I've asked for is my vehicle licence disc which was delivered to the car's registered address - the FMH). I don't want to fuel anymore acrimony from the ex, but I think I've made every reasonable request and I don't see any other course of action. Currently in the midst of residency application where cafcass have reported that there is a "high level of acrimony between parties"; they got that wrong it emanates from one source only!! Nevertheless, I don't want to escalate any more conflict but I'm a bit stuck here. Any advice welcome.

I would be inclined to try one more request, in writing (either from you or your solicitor)

- List the docouments which you need
- Provide a large SAE so he only has to put the documetns in it and stick it in a post box, and say in the letter that you have enclosed a stamped addressed envelope
- State that you need the docuemnts to be provided to you within 7 days of the date of your letter
-State that you would prefer to keep things amicable but that as this is the fourth time you have requsted the documents,you have sought advice and have been advised that the police will step in to recover your documents if necesary, and that if he doesnot now if he does not respond then you will have no alternative but to request them to take steps to recover your property.
I think setting it out this way makes it clear that you are doing everything you canto make it easy for him, but does make it clear that you will take it further if you have to.

If you are still involved with Cafcass it may be worth mentioning it to them - it isn't, strictly, anyhthing to do with them, but if you raise it (perhaps as one of the reasons why it's hard to work cooperatively with him) they may raise it with him and he may be embarrased into returning your documents ratehr than show himself as being uncooperative!)

Otherwise, I've already waited for two months, two letters to Sols and deadline already given - I agree with you about being reasonable and have agreed with police to send one more letter - which I did last week. Didn't provide a stamped addressed envelope though - good idea. Already listed post contents to ex's sols so ex knows what I need. Think she is desperate to create conflict wherever possible.I'm trying to keep correspondence with ex's sols to a minimum as I know she'll try and recover the costs.

Just a thought - is it possible that these documents have been binned hence the refusal to return them ?

I keep all my STBX's post to pass on but I can imagine for some it is more satisfying to throw it all away.

Hi Barbs, I think you are very perceptive and probably absolutely right - either way, it means tampering with someone's post so it looks like I have to defer to my original prospect of police involvement. Why do people get so vindictive and acrimonious? I only wanted my post from MY house.

Re car tav-you can apply for that at you local DVLA office-explain the circs and they should be able to issue you with a duplicate- just had to do that myself!
