It's been a while but I would like to update on my situation
and any advice much appreciated as always.
carrying on from my
original post - I called the court the following day and this time spoke to
a clerk (must have been the caretaker the 1st time)anyway I was told I
could indeed withdraw ancillary proceedings just had to download form D1
fill it in and send cheque for £40. I also enclosed a letter from my
husband and myself both signed.
I called my sol. to let her know
but she was unavailable, left message with her secretary who knew about
form D1 and said it's cheaper to do yourself! - no return call. The next
day I called again - no return call. The 3rd day I called again - no
return call. suddenly sol. gone quiet - then a sudden influx of letters
one after the other - saying please get in touch re: court date, get in
touch haven't heard from you, need this or that re: court date!!!
I call her office again and repeat myself secretary now won't say
anything other than you will have to make appt. (she had been told off I
could tell).
Day of court date arrives - I finish work at 4pm I
have a missed call from the District Judge on my mobile. I call court but
Judge gone home so I explain the whole fiasco to clerk who advises I put
everthing in writing to the judge including my complaints of sol. Husband
also had a call and spoke to Judge telling him the same.
I am
told no rush to do this in the meantime my sol. adds on another few hundred
quid on bill for pile of letters and demands £1500 now! I expain yet again
that I have had no income for one month prior to new job and will have to
wait until I have worked a month before 1st wage (2 months no income court
clerk advises I should be allowed extra time to pay bill)and also ask yet
again to arrange payment over a few months as on low income etc... last
week I receive a CCJ from my sol. I feel so angry I have never refused to
pay and sol has had a thousands from me already I just asked to spread it
out over a few months!
I write letter of complaint to sol. and
phone today to ask for response - apparently it's in post and i will get it
tomorrow. i also sent a copy to Judge with a letter explaining the list of
grievances i have with my sol, and copy of CCJ. Judge will call me on
Friday to discuss - i just hope he can do something that will help this
awful situation that seems to just get worse.
