Yes Dukey it was me who applied without realising I was doing this! I had no prior knowledge of the legal process and despite my pleas to not go to court my solicitor told me to sign on the dotted line saying it was just a form for financial disclosure and that we could sort out from there ourselves with a meeting of both solicitors and ourselves.

I was pretty ill at the time my doctor wrote a letter to my solicitor saying I wasn't well enough to deal with the process and my solicitor ignored it, so then my sister wrote to my solicitor explaining that I was barely able to function day to day. This was a while ago and I am able to function normally now I can also clearly see that there would be no benefit in going to court for both of us, in fact I do not see why my solicitor is pushing for it as there is just not enough in the pot to divide right now eg/ we have rental property if we have to put up for sale the tenants move out - creating debt and they are just not worth what they were so no equity therefore if they sell more debt.

I will write a letter from both of us and we are both going to sign it hopefully this will end the whole fiasco and we can get on with our lives.

Blue sack your solicitor and at the very least complain to the practice.

Out of interest is he/she a family law sol is the practice a member of resolution?.

It's been a while but I would like to update on my situation and any advice much appreciated as always.

carrying on from my original post - I called the court the following day and this time spoke to a clerk (must have been the caretaker the 1st time)anyway I was told I could indeed withdraw ancillary proceedings just had to download form D1 fill it in and send cheque for £40. I also enclosed a letter from my husband and myself both signed.

I called my sol. to let her know but she was unavailable, left message with her secretary who knew about form D1 and said it's cheaper to do yourself! - no return call. The next day I called again - no return call. The 3rd day I called again - no return call. suddenly sol. gone quiet - then a sudden influx of letters one after the other - saying please get in touch re: court date, get in touch haven't heard from you, need this or that re: court date!!!

I call her office again and repeat myself secretary now won't say anything other than you will have to make appt. (she had been told off I could tell).

Day of court date arrives - I finish work at 4pm I have a missed call from the District Judge on my mobile. I call court but Judge gone home so I explain the whole fiasco to clerk who advises I put everthing in writing to the judge including my complaints of sol. Husband also had a call and spoke to Judge telling him the same.

I am told no rush to do this in the meantime my sol. adds on another few hundred quid on bill for pile of letters and demands £1500 now! I expain yet again that I have had no income for one month prior to new job and will have to wait until I have worked a month before 1st wage (2 months no income court clerk advises I should be allowed extra time to pay bill)and also ask yet again to arrange payment over a few months as on low income etc... last week I receive a CCJ from my sol. I feel so angry I have never refused to pay and sol has had a thousands from me already I just asked to spread it out over a few months!

I write letter of complaint to sol. and phone today to ask for response - apparently it's in post and i will get it tomorrow. i also sent a copy to Judge with a letter explaining the list of grievances i have with my sol, and copy of CCJ. Judge will call me on Friday to discuss - i just hope he can do something that will help this awful situation that seems to just get worse.

No letter this morning, called sols office told that i will receive letter week beginning 1st nov?? Funny that is when sol is going on holiday, asked for email version and told secretary not in and other secretary ill. Called again and said this is just getting ridiculous please email copy they said they would try and do that today - so far nothing - what a farce!
