Can anyone advise on the laws for immigration following
separation of a marriage.
The person concerned is from Cuba and has been married to a Uk national for
almost 2 years. They have a child together. He is still on a probationary
visa and was due to complete his application for indefinite leave to remain
this April. The visa expires in June. The relationship has suddenly ended
and he is no longer living with his wife although he is still supporting
his child financially.
He works free-lance and has only been in the uK
since 2006.
His wife is reluctant to reconcile and will not sign his
papers of application for ILR.
Will he be forced to leave the
UK?
He is unable to return to Cuba as he has given up citizenship
there and will only be able to visit for a 2 month period. SO he is stuck.
I understand that he may be able to
appeal on the grounds of rights of access to his
son...or compassionate reasons. DOes anyone know of other categories for
elgibility to remain in the uK?
