I was hoping to get legal aid but have found out that I fail the gross income test (I would qualify on net income however). I needed to produce a wage slip and my gross that month was too high, I work as airline cabin crew and my salary fluctuates greatly, (a lot of variables). Could I just wait until I have a 'bad' month and then apply or will my salary be checked again at a later stage? What about ssp appearing on a wage slip? Would another one be required then?

Not sure how legal aid works if your salary fluctuates. Who did the first calculation? If you see a solicitor for a free half hour session they should be able to advise you. xx

A person has a duty to report any change in financial cirumstances so even if public funding was obtained on a bad month, a good month would have to be reported and a new means assessment would be carried out.

It sounds as though generally you are not eligible if you have good months and bad months unless you can use a lot of pay slips to demonstrate that you are eligible when averaging out 12 months statements.
