First steps of seperation 3 Months, 4 Weeks ago
|
|
Hi
My wife have just left after living together for 5 years /
married for 3.
Is there a legal difference between me sending
her stuff away / should I insist on her making the arrangements to have her
possession removed herself? I was told something to this effect, but not by
a professional.
Many thanks,

Its best to do it by arrangement, ask when she would like to pick it up, or
even offer to have it delivered if you can, your married so she has a right
to have her personnel effects in the marital home, if she no longer lives
there its best she collects them but try and agree a time and date to do
so.

Also, if you can, set a time limit to how long you should store her
belongings. A time limit helps to focus the mind. But be reasonable. I
would collect it all together. If you can bag it all up or better still box
it up. Then its easy for her to collect with the minimum time needed for
pickup. C.

My main question though is; should I avoid taking pre-emptive action? Is
there any possible ramification if I'm the one bagging it up, giving her
deadlines, etc. for her to later claim that I removed her from the home, as
oppose to her moving out completely on her own accord, which is what
happened.

Whatever you do try and make it by agreement, your married, the home
belongs to the both of you, yes she left, and if the marriage has ended she
will have to collect her belongings at some point but forcing the issue is
far from straight forward.
Remember its the marital home its not
yours.
