Who pays for the divorce: Respondent? 4 Years, 7 Months ago
|
|
Hi Folks, I have received my divorce petition form my wife a few days
ago. I understand from my solicitor that I if I accept the petition then I
pay the costs of the divorce. Is this correct? I should mention that I
live in Northern Ireland, in case the law differs from that that in
England. Thanks for any insight Stephen

I'm not too sure about NI but my understanding is it isn't that different
from England & Wales. Usually the person who looses a court case pays
costs, so if the respondent to divorce doesn't defend then if requested
costs against them are granted. If they do defend and loose costs are
awarded against them anyway. However, in E&W divorcing parties often
agree to share the cost of the divorce.
I should point out the
above doesn't apply to the financial proceedings.

I believe that if the grounds of divorce are adulerty, the guilty party can
be ordered to pay the costs.
