Re:Delaying Decree Absolute

I have been told that it is best to get the finances sorted before the Decree Absolute is issued.

I am concerned that my ex will apply for the Absolute asap yet we are no where near agreeing finances (and with his hidden money are unlikely to for a while yet). Is there anyway of stopping him from making the application when the 6 weeks are up, and if so what do I need to do?

yes you can ask your solicitor to delay it.I am in the same situation this is what my solicitor will do.Once this is through sometimes you are at a disadvantage,I x2b wants to bring his girlfriend over so if he can do this he will not be in a hurry to sort the finance out.

I'm self repping so not sure how to delay it - is there a form or an application I should make to the court?

STBX has a habit of disappearing when it comes to paying for his kids etc, but I know he wants absolute asap so this is my bargaining power at the moment.

You can write to the court quoting your case no. ­object­ing to the absolute going through setting out the reasons as to your ­object­ions.

Tasha, I note that you are the petitioner not the respondent.
It is only the petitioner who can apply for the absolute 6 weeks and one day from the date of the nisi. The respondent has to wait 3 months after the 6 weeks and one day.

In any case, if the respondent applies for the absolute before the petitioner, the judge will want to know why and you will get an opportunity to state your ­object­ions then.

Can I write or my solicitor should do it? Are there special form for this ­object­ion? I am afraid it can be late as he applied last week. How long does it take to get Decree Absolut?

Why don't you phone up the court on Monday and see whether they have actually got the request for absolute. If they have, ask them what happens now as you are the petitioner and will the judge be enquiring as to to why you haven't already applied yourself.
