Just thought I'd let everyone here know that I applied
for a refund for my divorce
petition and a full remission for my residence/
prohibited steps and
contact order.
It's a pretty simple process, not only that but the court staff are
helpful and understanding.
You need to have 3 months worth of
pay slips issued by your employer (if you're employed), and you need 3
months worth of bank statements. If you have
benefits of any kind, you also
need to provide evidence of these and include them in your income. Should
you have previously been getting benefits and this shows on the statements,
then you can try to explain this (for example, I just started getting Child
Benefit for 1 child, and they had credited an amount into my account. I
explained, using the letter from the HMRC how much money it was and how it
should be considered. They agreed with that and counted it over the whole
year and didn't treat it as a lump sum).
If you're under a
certain income level (or unemployed) then you will be give the remission
straight at the counter and not be asked for further evidence.
If, however, your evidence is incomplete, then your papers will be sent
back to you (or given back if you're still in court), and you will be asked
to provide the relevant paperwork.
It can create delays if the
evidence is insufficient (when you thought it was sufficient) and you end
up with the papers returned to you at home, but if you can have your
remission assessed at the court it's a lot easier.
