If he has chosen to ignore the Writ, it can be presumed that he does not
wish to defend the divorce application (or contest it, which is the same
thing really), so the divorce application can continue on an undefended
basis. This would be for divorce applications on the grounds of
Unreasonable Behavior or Adultery.
I think you are using
Unreasonable Behavior as your grounds for divorce?
If however,
you need him to sign a Consent form,(ie you are divorcing on the grounds of
12 months non-cohab) and he doesn't return the consent form to court, then
the divorce application in this instance cant proceed on those grounds.
The Writ would have been sent out by Recorded Delivery - did he
sign for the paperwork? If not, then another Writ will need to be sent out,
again by RD.
If he doesnt consent to a divorce on the grounds of
12 months non-cohab, and you do require his consent for this, then you can
apply for a divorce on the grounds of 24 months non-cohab (when the
relevant time has passed), and for this you do not require his consent.
