Yes, as he has said he does not intend to defend just go ahead with your
afidavit (you will be confirming, in that
affidavit, that the Petition is true)
Regarding costs - I assume that in your original
petition you were claiming costs from him; you will
need in the
affidavit to state that you wish to amend the petition
to limit the claim for costs to 50%.
In the affidavit, where it
asks whether you wish to amend anything in the petition put "Yes, i have
now agreed to limit my claim for costs to 50% of costs, disbursments and
VAT" and on the last page of the affidavit where you will see you are
asking the court to order him to pay your costs add "Limited to 50% of
costs, disbursments & VAT"
The appliation for special proceedure
is signed by your solicitor if you have obne, if not, you sign it yourself
and delete the words in the brackets.
The affidavit itself
however does need to be sworn in front of a solicitor (who will chareg £5 +
£2 fpor each exhibit (e.g. the copy acknowledgment) or you can swear it in
front of a court officer by going to any county court, in which case you
won't be charged.
