Respondant Changing her mind

Hi there,

I currently have just filled in my D8 and filed my petition. There are no kids, house or financially anything involved. The divorce is taking place in England.

At this time me and the respondant are on good friendship terms and she claims that she will not fight the divorce or the grounds for divorce.

However what i am trying to find out is if there is any way a respondant can change their mind and start "creating problems" to lengthen out the divorce? is there any stage they can change their mind?

It is possible to defend the divorce proceedings but there are short timescales to do this. If you issue and an acknowledgement of service is completed with no indication of a defence, you will be home and dry.

Hi there thank u very much for ur speedy reply.
So what ur saying is when she has replied to the petition and when i send in the forms for the decree nisi is when im home and dry and she cant really do anything to create problems after then.

Correct. She can ­object­ to the Decree Absolute being issued but only if it will cause financial hardship.

If you are dealing with the finances at the same time you need the DA to give effect to any financial settlement so you will have to deal with it sooner or later.
