Re:DIY financial settlement

Hi I have my nisi since 2010, I have been trying to get legal aid but they say I have to much money in the 2 properties even though at the moment my husband will not do anything ie mediation etc in order to settle the financial side. We have been married since 1988 and split up due to his unreasonable behaviour. I under stand that I can apply myself as I cannot afford a solicitor .how do I go about it

To issue divorce proceedings you will need to complete a divorce petition and submit it to he court with a fee of £340. There will be a guide in the library on this site.

Financial proceedings, often referred to as ancillary relief or financial remedy proceedings, are dealt with separately usually under the same court case number but these are effectively a separate matter. Again, you need to complete an application which is a one page form called a Form A and submit this to the court with a fee of £240. The court will list the matter for a first directions appointment (FDA) but will give directions in the notice of hearing for you both to prepare a financial statement (Form E).

Start with the divorce petition first and ensure that you get it right as it costs £100 to amend it if you get it wrong. it is *very* easy to make a mistake on the petition.

Thanks Charles I already have my nisi and have just filled the forms for absolute . I didn't realise that I could apply myself for financial settlement and it's this part that seems to be very difficult to understand is there any help I can get to fill out the form e

Form E is long and complex, but there is a guide to the questions on this site. Just type in Form E on the search bar and hopefully that will help you. Any questions along the way just post on here and someone will have an answer.xx

Can anyone help, I applied for my decree absolute but because it is over a year I have to submit an affidavit in support of why I am applying after 1 year what do I have to put in the affidavit and is there an affidavit form I can print out
