Need advise please.

My husband and I are seperating following the revelation that he is in fact bisexual and wants to go and ' find out about that side of himself' suprisingly Its a bit of a relief really as I havent felt like our relationship has been great for a while now. We get on really well and so far..so good..this is a pretty amicable split.
The problem is he makes around 16k and I make 34k. The kids still live with us both and when we eventually move out we expect to have entirely shared custody. Currently he cannot afford to pay his half of the bills etc as he earns less...I dont understand where he is supposed to find any financial support and I dont see why I should support him considering he has felt this way since the year we married ( 7 years ago) and I was the one who took the career break to have kids etc...he just never really bothered to increase his earnings.....
How can he get financial support....AND....an I going to be expected to pay him spousal maintanance ?

Please help....very confused...thanks x

I am guessing that you are currently taking home less than 2.5k so the possibilities for SM are limited particularly given you have children to also support.

The financial split will potentially be a little complicated because of his low earnings, you on the other hand earn a reasonable salary and would have greater ability to raise a mortgage.

You say you are separating. If you want to divorce you'll need a reason and the easiest one is if the two of you decide that one of you has committed adultery. The last time I looked sodomy was not adultery in the legal sense so don't be too specific.

If you are the Parent With Care then you need to show your the income requirements to meet your reasonable needs. If your income is just a little bit short the court will probably say no SM.

Splitting up the capital assets will be problematical, however you could argue for the lions share as he will be less encumbered by the children and to be frank, will have far more scope to increase his earnings; you won't.
