Clean Break an option?

Could someone offer advice on Clean Breaks?

I have been divorced for 18 month, I have one child who lives between my ex and I on a 50:50 basis however I pay CSA to my ex (purely because she has the child benefit).

When we separated and then divorced we were renting, had joint debts (IVA) and no savings. We have now cleared these joint debts and my ex has set up home and moved in with her new partner.

There was no financial settlement during the divorce. Are we both open to future financial claims against each other such as receiving an inheritance or winning the Lotto? If so what can be done to stop this? Can we have a clean break if we have children?

If you have dependent children you can still have a clean break on assets and inheritance, you may need a nominal order for the children.

So neither of you would ever be able to claim for what the other owns or inherits, but if the kids are young you may have a nominal order which is often 50p or £1 per year that you don`t actually ever pay, if your ex were to lose a job or become ill then you may be asked to pay some money to help.

This is actually quite rare, nominal orders tend to stay nominal orders never being varied.
