Re:How to split the assets?

Hi,

Divorce papers are being filed as we speak and we now need to agree how to split the assets.

I have no interest in Ex's pension, car, money or anything. What has been whittled away has been done and not on my conscience.

However the main asset is the matrimonial property. There is one child from the marriage and we have agreed to arrangements where child is with Ex every other weekend and one night a week. Have agreed to share the holidays equally too.

However how do we split the property?The divorce calculator says 60:40 but this is ­base­d on 4:3 split of time but thats not strictly true.

Ex is bringing up age difference, earnings etc and aiming for spliting the property in two. Is that fair?

So tempted to play hard ball but also want this over.

I earn more but thats through hard work. Why should I be penalised? Also the majority of assets in the property were bought by me as I earn more. as going to suggest that Ex take what he bought.

The financial division is always complicated. The usual rule of thumb for a long marriage is to start at 50:50 , but that is just the starting point and there is usually a whole range of outcomes that would be considered fair. The fact that you earn more I don't think counts for much and could actually count against you as you have less need and would be better able to raise a mortgage. The divorce calculator is a somewhat blunt tool and can't take into account the unique nature of everyones position. If you post the following a knowlegabe wikipeep will be able to offer an opinion on what would be concidered a fair settlement

Your respective ages;

The number of children you have and their ages;

How many nights the children spend with each parent;

The length of your marriage and any period of pre marriage cohabitation;

Your respective incomes;

Your respective outgoings;

Your assets - both soley held and joint;

Your liabilities.

When you say 'play hardball' that might end up lining the pockets of solicitors in costly court proceedings. Using mediation may be a cheaper and better way to go before that route.
