Re:financial settlement

Thanks for the advice I won't fall into the trap (I'll try not to anyway!!)

I really don't know how much I would be happy getting, obviously the more the better!! but I am thinking less each day. Before I read up on this I would say I would expect 35k (didn't know bout short marriage thing then) now I'm thinking nearer 10 or less, just enough to get me back on my feet, fingers crossed!! I had a friend who got 3k when she left. They weren't married and she never paid anything at all towards bills, mortgage etc... so I'm hoping to get more than that!

I have tried to discuss things with my husband, I will listen to any suggestions, but he won't discuss it all. He is under the impression that he can ignore all of this and it will go away and he is blaming me for the break up, which is not true.

I have tried to come to an arrangement.

Just wondering if his solicitor has said something like "short term marriage so she may not get much at all, keep your head down and tell her to get her own solicitor, maybe she'll go away"
In my opinion he has stolen ten years of your life and just compensation for that is much more than he could ever afford.

Just an update, I now have apponted a solicitor and he has said that I will be entitled to something between 35 and 70. He has written to the other solicitor and also put in for mediation. He thinks it could be sorted by end of Jan if he is cooperative (which seems more likely now), if not he will put in for the judge tosort it.

I have also appliedto have court fees refunded as my income is so low at the mo (no supply teaching work around!). I wasn't aware that I was able to this until I spoke to the solicitor.

If you are applying for legal aid ..just be aware it is not a freebie and if you get awarded a settlement the costs will be deducted from that ...so again be careful don't run up a huge solicitors bill..

You were not married for long but did you cohabit beforehand? And if so, for how long. This will make a difference as in cases where cohabitation goes seamlessly into marriage, the entire length of the relationship is relevant.

You need to bear in mind that the reasons for the divorce and his behaviour will have no bearing on any financial settlement. It boils down to hard figures.

Also bear in mind that the question is not so much what you want - but what you need - to re-establish a home etc. Have a look at section 25 of the 1973 matrimonial causes act - this sets out the factors that are considered.

I have read all that has been said and I think that you should have a go at the divorce calculator! I have been married 4 years cohabiting for 6 years before marriage and I have been advised by my very good solicitor of what I am entitled to so maybe you will be entitled to more than you think.
