Re:car finance

Hi all I;m having problems with an ex and could do with some professional guidance! After spending 3 years living together he replaced my car with a brand new one. (using my own fully paid and owned car as the deposit)The finance is in his name and all the car paperwork is in my name. He was away with work for 4 months so I paid the 1st 4 months car payments into his account to cover them while he agreed to put money aside for xmas. upon his return he left me for someone else. At the time he agreed to pay the finance as he knew i needed the car for work and hospital appointments. He has now changed his mind as he can't sell his own car (it is in negative equity and still has a large hp loan on it)and wants to move out of his parents. I don't have the spare money to pay the outstanding hp finance and he is now thretening to take it away. If this happens I can't get to work and will loose my job! Is there anything i can do to keep my car?

I have seen this situation before and it is unfortunate but HP companies can be really difficult. The positive that you have is that the car is registered in your name. You should try contacting the HP company directlty to see if you can have the finance transferred to your name and for the payments to be reduced to an affordable level or in the alternative depending on the amount left to pay if you can pay the whole sum off by way of borrowing money from elsewhere (or certainly somewhere that provides better rates).

The only alternative is that you allow for the car to be sold and use any money you have in the car towards another car.

Thankyou for your help. The car was only purchased in july for £12k and has £9k still left to pay. unfortunatly I am unable to make any payment towards the car as he left all the househol bills for me to pay so things are already tight.

I dont think he will go down the default/reposession route as he is trying to buy a house however can he hand it back, sell it or take it without my say? is he entitled to anything to do with the car?
