I wish to separate with my partner. We are joint mortgagees and I've got
past the fact that the euity is 50/50. My question is: since I pay all
the bills exclusively (mortgage, C/tax, electric gas etc)can I insist that
she pays half of them? If she does not pay, can this be taken from her
share of equity once proprty is sold?

I think more is needed in the way of info. it appears you share a
house with your partner, you are separating and selling, you want her to
pay half until his happens. I guess in the past she may have paid for
food etc. If this is the case and you both basically contributed to
the house, then I guess if she is no longer cooking for you etc then that
would be the route to go, but it aint going to be easy as one will accuse
the other of using more hot water etc? In a marriage split, whatever
happens leading up to the divorce has no effect on the equity or other
split.

OK, to help clarify: I owned my house which I then converted to joint
mortgage a while after my partner moved in. We are not married but I
accept that the house will be owned on a 50/50 basis. I pay each and
every household bill in full, this comes to some £1220pcm. My partner
and I are separating, but she will not leave the house untill she receives
"her half". Until the valuation, sale or negotiation on what "her
half" actually is, I am still paying the full value of the mortgage as well
as servicing all the household bills. Question: does anyone know of
any precedent, principle or legal practice that wil support my cliam that
she is finacially responsible for half the running costs whilst she remains
in the house and, in the absence of payment of £610pcm, then that sum can
properly be deducted from any share of the equity following sale?

OK, so it depends on how long she has been there, and if she has an
interest logged on the land registry? Seems like you need to come to
an agreement, with help, are you not living in the house? You have the
right to change locks etc.
