Dear all, I hope that somebody could point me in the direction.
I split up with my ex-partner (we were never married) two years ago. I
had to go to great expense, however successfully was granted an order of
sale. My partner and her two children aged 16 and 18 were allowed to reside
there until sale.
My ex partner did every thing she could to
prevent the sale, leaving the house in bad order, not allowing viewing by
being obstructive etc.
I could not release her from the mortgage
because of my credit rating (defaults etc) and the house was not selling. I
begged the building society with no avail.
I have paid now paid
her several thousands pounds to leave the property, it was my only option
without paying a fortune at court again. She has been released from the
Deeds (which she agreed too) but NOT the charge on the property. Our
mortgage company would not allow this etc.
I know want to rent
the property out to start repaying some of the debt, the mortgage is
interest only. The building society says that this is fine, but require
BOTH our signature.
Just to be difficult, she is refusing to
cooperate and make any
contact.
Is
there any thing I can do, if necessary by the court to secure this?
Any help would be gratefully received.
