Mortgage after seperation 6 Months, 4 Weeks ago
|
|
Me and my ex have a son together and we brought a house 7 years ago, where
we are joint tenancy on the mortgage.
We split up just over two
years ago and he moved out. We agreed between ourselves that i would stay
in the house with our son and since then i have been paying the mortgage by
myself.
I am trying to get the mortgage moved to just my name
(staying with the same mortgage company and not changing any of the terms
or conditions of the mortgage)however i have now hit the part of the
process now where by according to their affordability calculations i can't
afford to pay the repayments, yet i have been paying it for 2 years. They
have my payment history.... Is there anything i can do?

Hello pinkfish and welcome to wiki.
Were/are you and your ex
married?
This can make a difference to how things are sorted
out between you.
Unfortunately regardless of whether you were
married or not, you cannot force a mortgage company to take you on. It may
be worth shopping around - perhaps talk to a good IFA about the situation.
However I can see that a possible sticking point may be that you do not
have the finances settled ... and he may have a claim on some of the
equity.
On the other hand, he cannot take himself off the
mortgage either. Make sure you keep a note of any capital you are repaying
- that may be able to be taken into account when finances are sorted.

thanks, that's kind of what i thought but wanted to check... and we were
never married, just lived together. Think it's a case of a good FA now to
see if they can help
