The Family Law Act (Scotland) 1985 is more up to date than the Matrimonial
Causes Act 1973 in England & Wales and for the majority of divorcing
couples the law works fine in Scotland. A small minority of more
complicated cases get trapped in the court system which was described as
"Victorian" by Lord Gill who recently reviewed the civil courts.
Currently Gill's recommendations for change are under consideration but
unfortunately any reform is likely to be too late to help those going
through proceedings now.
