I am past the stage 1 of the divorce procedings the Decree Nssi, my ex wants to skip stright to the Decree Absoulte.
Without sorting out the FMH and finances for our two children. My soilctor says it is right to defer I do agree to a point finachial discousure has occured to our own solictors and my solictor has applied for Axcliary Relief on my behalf.
My ex earns between 42 - 45k per year owns another home he obatain 2009 after his father pass way in 2008 and buy out his brother and sisier with a full mortage on his own property.He does pay the mortage to the FMH. I am just concern with costs to my solictor and the ongoing nature it may be quicker if me and ex come to an agreement so a consent order can be drawn up.I am also not in position to have the mortage in my name due to earnings and some debt, my ex is leaning to have the home FMH mortage in his name as it is due remortaging and at later date once the mortage is secured I could have my name added we belive.I am leaning to a 65% split to me and 35% to my ex on assest of FMH.

I apperciate their is so much information and also the children are 8 & 9.

My solicitor has advised me not to apply for decree absolute until we have sorted out the finances. I know that every case is different but I think it is a pretty consistently given out piece of advice one this forum. Are you near enough agreeing between you what is a fair split? If you can agree between you then maybe the ancillary relief application is rather premature.

I am missing the point and being advised wrongly as I don't want to occur any more cost or time what is the axclary relief and in terms of agreeing to a fair split we will be at this stage very soon as we are both throughly fed up of this procress and I am not greedy

Ancillary relief is an application for financial relief which runs along side the actual divorce. If you petitioned for divorce it is usual to apply for all the different financial orders in the prayer of the petition to leave all the options open. If that is what your solicitor means when he/she said he has applied for ancillary relief then the next step would be to try and reach an agreement between yourselves.

When no agreement can be reached between the two parties an alternative is to commence court proceedings using Form A for the application.

That clears up the Ancillary relief, query I am the reciever and to note hoe long does the Ancillary relief normanal take.
Also in your knowelegede I am also not in position to have the mortage in my name due to earnings and some debt, the ex and Iam is leaning to have the home FMH mortage in to be remortaged again it was last remortage 16 months ago and it may only be the simper way I recieve a lump some and at later date once the mortage is secured I could have my name added we belive.Would this hinder the transfer of the proerty.
