Re:Who is entitled to what ? Advice please

My husband and I married 10 years ago. I already had 2 children from a previous marriage (who have since left school and are now at work) we have 1 child who is now 9. We moved from our shared council house into my husbands deceased parents house, which he soley interited 2 years ago. Now I want a divorce. I also inherited an amount of 80,000 uk pounds when my farther died 3 years ago which i have invested in bonds.
I understand that my husband has to ensure my housing needs are met with regards to our daughter but how would the house/saving bonds/debts be split? Any advice would be greatly appreciated. many thanks

Divorce settlements aren't about entitlement, in most cases settlements are determined by the "needs" of both parties. The value of any assets (including pensions) held in joint and sole names forms the matrimonial "pot" which is shared according to a checklist of factors in s25 Matrimonial Causes Act 1973.

The priority is the welfare of children and if your daughter lives with you most of the time your needs will be for a property where she will be adequately housed. Your husband will also need to be housed where your daughter can stay when she is with him.

A good starting point is to consider if the former matrimonial home is bigger than either of you require and research local property prices and both parties' mortgage raising capabilities.

Each case depends on the specific facts eg if your income is less than your husband's you won't be able to raise the same amount of mortgage which could justify a larger share of capital in your favour. On the other hand if your husband is much older than you he might not be able to raise the usual 25 year mortgage and that could justify a split more in his favour.
