MONTHLY EXPENSE SCHEDULE

I hope someone can help give me a few pointers into filling out this form that my solicitor has just sent. I am living in FMH and STBX is still paying intp joint account so expenditure is split between us. Do I put in figures for half the mortgage/water rates/gs/insurance etc. or the whole lot as I'm the only person living here? I don't understand why the form isn't more clear as there seems to be potential to be a huge margin of error if not filled in correctly.

We're at the stage of trying to get solicitors to advise what would be a split awarded in court and then to attempt to further negotiate ourselves for the solicitors to draw up a consent order. Even this litle form makes me feel really sick and scared and I've been having nightmares the little time I did sleep last night. In the first couple of weeks after our split last October my solicitor advised me 60/30 plus spousal maintenance to me (wikivorce caluclator matched). My husband told his solicitor a load of rubbish about what I earn (he added several years of my self employed income together to come up with an average) so he was told 50/50 and no maintance. His income is about five times more than mine. I don't earn enough or regularly enough to get a mortgage. Married 32 years. Both mid fifties. No dependent children.

Sorry the last lot paragraph not really relevant to my question but I guess I just needed to rant and rave!

You include everything, not just what you pay monthly also include annual payments such as TV license car insurance ect, if you do make annual payments just divide them by 12, if you still by the kids birthday presents include them also.

The aim is to provide your actual monthly needs, so its not just the basics its the lot.

If you are self employed its very easy to provide your accounts form the year you registered to now, usually you take the last three years to provide an average income.

I still don't understand if I need to put in 50% of the mortgage payments etc. when STBX is still paying into joint account?

For now this is an informal negotiation so state what you spend now, ie 50% of the mortgage.

If this fails and you end in court a much more detailed disclosure is made with a 28 page document called form E, this form have a section for future income needs, so if you get to this stage then you would state what you need post divorce without the assistance from your husband.

When your divorce is final does he want his name off the house? is he expecting you to take over the mortgage or are you expected to sell up?

I think this makes a difference.

Income and expenditure form to me needs to be filled out as it is. Income is your wage and the interim maintence payment you recieve from your husband. And your expenditure is 100% mortgage and all the other bills.

I'm sure he will write his payment to you as an expenditure.

The house will have to be sold so that we can each have a more modest home of our own. Solicitor has asked me to take in a bundle of estate agent details of houses that would be suitable for each of us. That's a difficult one as well - not sure whether to take in details of houses that I consider reflect my needs (room for working from home, spare room for grandchildren to stay over, garden for dog etc.) or details of houses I think I might be able to buy mortgage free - don't want to shoot myself in the foot and I know STBX will not be prepared to compromise in the sort of property he buys. He still seems to be of the opinion that all our assets are his, just because my business has struggled in the last couple of years, and now I don't even have the confidence to try to get work let alone do it. I'm only getting by financially by selling my personal possessions while he's living a great life doing what he wants and buying what he wants. Divorce just isn't fair!
