Been over a month, havnt heard from court

Hi, I need abit of advice please. I sent a divorce petition over a month ago to my ex wife to be. I know she has received it and doesn't want to go ahead with it. She wants us to go ahead with her petition and withdraw mine. My first question is does she have to reply to the court on whether to defend or accept the divorce in a particular time period? If that's the case why havnt I heard anything from the court? It's been over a month.

Secondly she keeps saying she has sent her petition to the court too. But I have not received anything from the court. Does the court send her petition to my solicitor who then passes it to me or does it come straight to me?

My solicitor sent a letter to her solicitor stating that we are willing to withdraw our petition if she agrees that we only pay our own legal fees and since we were only married for a year we do not claim ancillary relief. She replied back saying aparantly it's illegal to bargain like this. Is that true?

I would like your advice plsss. I feel so stressed.

You've been going round the houses on this haven't you? Ultimately who divorces who matters not a jot. If you want a divorce, suck it up and agree to whatever UB (could be an acronym for unbelievable bollocks) your S2BX proposes and get on with it.
I understand it is normal for a short marriage with no kids that each party leaves with what they brought to the marriage. Bargaining is not illegal. Going to court for ancillary relief is expensive for both parties and avoidance of it is a good idea.

For info, my S2BX insisted she had to be the applicant because I was more unreasonable and she was worried what people thought of her. I acceded and you know what; people who know us didn't care at all.

What Tefkas says is correct. It doesnt matter who divorces who. My ex divorced me. She had the affair and I thought, why should I pay to get you out of my life? I made the UB reasons up for her. Just chose opposites. So it dont matter.

Its not ilegal to barter this way. In fact this is how its done.

One last point. Dont expect anything to happen quickly via the courts at the moment. They had some serious downsizing last year. This time of year they will be processing drunk drivers and there is always a spike in people wanting a divorce at this time of year. But the courts take there time in any case. C.

Hi, thanks for the replies. my soon to be ex wants me to withdraw my petition so she can send her one and wants me to pay half of the court fee! I have already spent money on court fees now she wants me to contribute towards hers!!

Also solicitor takes forever to forward the letters sent to him by my ex's solicitor. Its been nearly 2 weeks that he got a letter from my ex's solicitor and I still havnt received it. He said he sent it by 2nd class post and what's me to contact royal mail, what cheek!! Also, he sent me an email stating the letter is attached to it but it's not. Tonight he texts me saying he wants to speak to me about his fees, presumably he wants more money. Has anyone experienced behaviour like this from their solicitor and what can I really do about it? If I complain or refuse to pay him more then he will just tell me to find another solicitor?

Does anyone know any good divorce solicitors in east London area?
