Prior Debts

Hello all,

Just before my stbx and I seperated (Jan 2011) we converted the loft in the FMH and I took out an HP agreement for a new bathroom (Oct 2010) the payments are now due to begin (the agreement was buy now pay in one year)
Verbally my STBX had agreed to make these payments as it seemed unfair I pay for a bathroom in a house I no longer reside in. Since that verbal agreement my STBX has now distanced herself from ever agreeing and therefore the finance company are chasing me. The agreement is in my name, at the address of the FMH.
There has been no financial settlement in terms of the divorce yet as the ex says she has nothing to offer me - cannot buy me out, cannot take on mortgage herself, she earns a little more than I do.
I make regular CSA payments, we have two children 8 & 5.
If she is resolute about not making these payments I will have to make them - I have heard the CSA might/would take this into account. Can anyone verify this or think of an alternative solution ­base­d on the assumption the STBX absolutely will not assist?
As my STBX is not prepared to settle financially and I don't really want to see the kids uprooted we are in a sort of stalemate in terms of divorce, therefore I am renting a room off a friend and trying to rebuild to be able to buy and house the children.

Your marital status and any verbal agreement made are unfortunately no concern of the HP company. The debt is in your name and you will be expected to pay.

It will, however, be included in the marital pot when assets are divided.

You could talk to the CSA about this but I doubt it would make any difference. If you are making payments above the CSA level I guess you could reduce them.

If your stbx is not prepared to discuss a financial settlement, it may be that you have to force her hand by applying to the courts for it. That does not mean you should not still negotiate and try to settle out of court - but it does mean you are both then in a court ti­meta­ble and answerable to them if you do not comply.

Bear in mind that if there is no financial settlement and you are able to buy again, it is possible that any new purchase could be included in the assets pot.
