My husband and i have been seperated for more than four years now. I want to file for divorce on the two year seperation grounds and have two questions regarding questions that i have seen on the D80D form that i am looking into.

I can't exactly remember the month we stopped living together, it is one of two months...i am worried that if i put in the wrong month the divorce gets stopped when they cross reference the details. Should i try and dig up old documents (that are stored in another country from where i am at the moment)?

The second question is that we decided a few months after living apart that it is def over between us, do i fill in these seperate dates?as long as they are both more than two years ago it should be fine to file for divorce now on the 2 year seperation grounds, right?

You have lived apart for over four years so just agree a date you separated its not deceitful, its more than two years thats what counts, you can word it "on or around (date) the petitioner and respondent separated and since that date have not lived together".

Thank you dukey that great to know!was a bit worried about that as i really wasnt looking forward to try and find paperwork in another country...one last question (for now ) he has since had a child with another woman, i think i saw something saying we have to list children even if they arent ours (we dont have any together) why would that be the case?

You would only include children of the marriage ie children by him and you and children of the family which are children that were with you while you were together, you have no children of the marriage or the family, if you think the forms are a bit much wiki offer a solicitor service so you don`t have to complete them @£179 or including the consent order £279.

Oh believe me i am looking into paying for the wiki service...even though it should be very straight forward i still dont feel like filling in the forms and making a very costly mistake somewhere!

Personally i think the forms are far from clear and nor is the guidance provided, another bug bear of mine is if you do make a mistake court send the form and application fee back with little or no explanation, when an explanation is given it may as well be in Latin "the application was refused under section bla bla bla" what use is that! if you don`t understand the form what chance do you have with statute..............and one i see all to often is D80D is refused due to an incorrect article , so whats the article, well its the ex`s signature written wrong, if they sign J Bloggs and you write John Bloggs they send it back

I agree, the forms are very unclear hence why i will def use a service to fill them in for me. I never thought of myself as stupid before but after reading them....mmm i now have to wonder since i dont understand half of it!

It is a very upsetting thing that you go through and better forms would def make it easier on you. I am dreading my forms coming back for whatever reason since you hear so many stories. E.g the signature one you just used earlier, i mean seriously!?if both of you decide it is over surely it should be an easy, straightforward process...you would think!
