Re:Form D11

Ex has not sent acknowledgement back but has written to me stating he has received divorce petition and signed the letter. The court has told me that if I send a copy of his signed letter to the court with a letter to the Judge with the facts, £45 plus a form D11 completed, the Judge will decide whether the divorce will be able to proceed without acknowledgement from him. Does this sound correct and would I need to send in any other forms with it. The form does seem a bit complicated especially question 3, not quite sure what category I would have to put on this question.

Any help would be appreciated. Do I also need to fill in affadavit at this stage

yes, it sounds as though the court are suggesting that you ask for a direction that service has been effected.

at 3 you are asking the court to make a direction that service is deemed to have taken place.

that would then allow you to comtinue with the divorce.
the 'why' is that you have received a letter from your ex (attach a copy) stating he has received the petition.

I think you should be fine just giving fuller details in box 10, without needing an additional affidavit. Reference the letter and confirm that you can identify thesiganture as being that of your husband
