Consent Order

After short marriage of 1 year I am petitioning for divorce from my husband. There are no children, no property, savings etc., We had only known each other for 2 years. We are both financially independent so I am not ticking any of the boxes in subsection 3a of the Prayer on petition. My ex seems to think I must do this for him to get a clean break consent order. Can he arrange for a clean break consent order for me to sign if he is so keen without me having to tick all these boxes. Also if he does, does he present this to the court handling our divorce after I get the decree nisi. Would the court rubber stamp this order even though I have not ticked these boxes.

Don`t worry about the box`s on the petition, its common practice to tick all of them bar MPS in your situation, it does not mean you intend to ask for any of those provisions its just the way its done.

The CO for you both is more about dismissing future claims on assets income and inheritance, it in other words ends any chance of either of you asking the other for money in the future.

You can have a consent order if you ticked them did not tick them or struck them out, in other words you can have the order regardless.

Thank you, that has really cleared that one up for me. Ex was trying to convince me we could not do a consent order unless I ticked them.
