Final hearing-settling before 3 Months, 3 Weeks ago
|
|
I have been through the FDR with my ex, no agreement, but close. Can we
come to settlement by exchanging offers before the final hearing and avoid
such a costly time in court?

Yes. It is a good idea to do so. You can vacate the hearing if you
agree.

I was hoping you would say that. Is very costly. So the whole final hearing
can be avoided?

Yep, often the amount that divides the parties is swallowed up by the cost
of the final hearing. A compromise by both parties can see an early
resolution to the matter and a saving for both parties.
Be
warned though, preparation for the final hearing begins around a month
before the final hearing. If you were to settle on the morning of the
hearing you would still have incurred 90% of the costs from the FDR to the
final hearing. If you settle a week before you would only incur around
70%. A month before and you incur 0% of the cost.
