Non-compliance with Consent Order 6 Months, 1 Week ago

I divorced 6yrs ago but my ex continues to fail with regard to the
undertakings & orders contained in the Consent Order. Whenever I have
reminded him of his obligations, he uses it as an opportunity bully me (I
divorced because of abuse)to the point that I have given up trying, most
notably with regard to the RPI increase that is supposed to happen each
year with regard to our daughters maintenance, there has been no increase
since 2006. I have now managed to get myself together and at last feel
emotionally strong enough to deal with a number of outstanding issues,
although I do not want to waste my time attempting to deal with my ex
again, therefore, what is the exact procedure for returning to Court to
force him to fulfil his obligations. Do I have to return to the court that
dealt with our divorce or can I use a local County Court. Is it possible to
undertake this myself and what documents do I need. Many thanks for
your suggestions.

You can do this yourself its not that hard.
First write to your
ex asking him to comply with the order in say 14 days or you will take it
back to court and seek costs, doing it yourself you wont have any costs but
its worth mentioning so he knows how serious this is.
I no joy
download form D11 in the wiki library state you wish to have the terms of
the attached order imposed by court, staple a copy of the order to D11, and
take it to court and pay i think £45.
In time you and your ex
will get a letter from court giving you a date for a hearing, you both
attend and he will have chance to explain his actions, unless he offers a
solid reason the terms will be enforced by the judge.
