Took completed D11 to court hoping to get ex to pay mortgage as per CO but
they have never known it used for such.
As it costs £90, they
suggested I get 30 mins free advice with a sol rather than waste my
money.
A free 30 mins is in expectation of handling a complete
divorce, not a freebie when all should be done and dusted.
I
asked "if it's not D11, what should it be?" They had no idea.
It
was a mistake by my
barrister to separate the mortgage to be paid by ex
direct, and SM to me.
Had the mortgage payment and SM been payable to
me, I could have lodged the total for a £20 fee in the magistrates court as
I did with SM.
So is D11 definately correct? Does seem rather
expensive to enforce a CO.
