use of intercepted SMS/emails in petitions

My wife accessed my text message after I told her not to use my phone whilst I was on the loo/asleep. Now I have this passage in the petition which i think has already been sent to court :
"
although he has refused to admit adultery. The Petitioner however has
discovered inappropriate text and email messages between the Respondent and this other woman
which confirms the Petitioner’s suspicions that her husband has been having an inappropriate
relationship with the woman."

I did not commit adultery; and she got the wrong idea of the relationship.

My sol ignored this fact; do I go to court and represent myself and have it thrown out; contact her sol and suggest they retract this statement or other.

All my sol has done is say we will not pay full costs. I am assuming that nothing in the petition will affect the financial outcome.

The key phrase is "an inappropraite relationship" that stops short of saying adultery and the levels of proof required is a lot lower. I assume that you are being pettitioned on grounds of Unreasonable Behaviour rather than adultery. This means that there is little point in trying to contest the divorce as its futile and expensive to do so.

Divorce is 'no fault' so what is in the pettition has no relevance when it comes to the financial resolution (unless possibly you were a heavy gambler etc)

I think you hit the nail on the head. That is perfect thank you very much!!.

No point going to the hassle of a defended divorce and incurring the costs involved. You can state that you agree the marriage has broken down, but disagree with the allegations and reserve your right to defend them if they should be raised in the future.

Very rarely does conduct have any affect on the finances and the allegations aren't on the absolute divorce decree which is the public record. All the other documents are archived by the courts for a while and then destroyed.
