After 4 years of being divorced my x wife has decided to send me a fORM 5. At the time of divorce we had a voluntary agreement about maintainance and when the house would be sold. She has failed to adhere to this agreement by not selling the house last year. My question concerns her behavoir.For the last three years she has sent me very abusive txtx. I did involve the Police several weeks ago but they just made it worse. She is still sending me the abusive txts. I am considering writing to her solicitor informing her of this behavoir, and asking that my ex wife signs an undertaking that she will not send me any more abusive txts. I was wanting this undertaking before I sent the solicitor the completed Form E. I am able to do this(I am acting for myself in the financial settlement). I am unable to change my mob number as my ex wife would just get my new numbe from my children. Thanks

Do you have any need to contact your ex?

If you can do all your contact directly with the kids most phones allow you to block certain numbers.

Or just delete the texts and not read them.

Inform her if the abusive texts continue you will do either of the above.

Its a good ideas however to create a transcribe or photocopy of any texts - this will build up a picture of her behaviour and may be used against her.

Whatever you do, do not retaliate with texts back.

Its a shame that 4 years after the divorce, she is sending abusive texts - what do you think she wants to achieve?

The best thing to do is get your phone provider to offically print out all these abusive texts in an acceptable format.

Take them to the police again & ask them to visit her!

I would also write a letter to her to stop sending you abusive texts and the action you are prepared to take if she doesnt!

I would also send a request direct to her sol too, he will know the implications of such harrassment and hopefully advise her to stop!

Keep copies of these and include them in any corrospondence with court - with an explanation of the harrasment and difficulties she is inflicting on you.

I would seek the advice of a solicitor or indeed there are legal advisors on this site who may help in constructing your letter.

4 years is a long time to be putting up with her abuse, stand up for yourself or she will just keep doing it as she seems to be doing.

Thank you for responding to my query. Your advice is very useful and I will obtain a printout of the abusive txtxs from orange. I will use attach these to my form E and write to her solicitor.

4 years is a long time to put up with such absuse. The fact that I have four children has prevented me from asking the Police to charge her under Sec 1 of the Protection of Harassment Act. But I will use her behavoir as a relevant factor for the financial settlement.

I believe you will find the maximum a phone company can go back on SMS storage is 180 days. It was when I was a network technician for Orange as I used to do that all day long.
