I have my court date this Wednesday,and am a bit apprehensive to say the
least. just wanted some advice on what people think would be fair.
were married for 24 years, I am 49, he is 54.we have been separated for 3
years now, two teenage children, 14 and 16. the divorce dragged out by my
ex, ignoring letters, not disclosing true figures, insisting on expensive
house valuations etc.
in March 2009 He was made redundant and
received a 12k redundancy payment ( tried to hide from me) whilst he was
still living under the same roof, but seperately. he finally left the
family home in July 2010 taking up
residence in our first
home, which we were previously letting. he made no payments for our
children when he left in july, despite the redundancy money, started paying
when he was employed in the following march,(The payments were not in line
with csa guidelines, approx £40 a week under paid) and payments were often
missed and sporadic. ( have now contacted csa)
we have 2 houses, mine
valued at 180k, mortgage 168k and his 110k, mortgage 90k,i have paid
repayment mortgage since he left, he has paid interest only. He has 2
pensions ( stated as minimal on ancillary
forms) eventually valued at approx 100k, i have No pension, we were to use
his pensions to retire with, we also have a cash sum of 120k (Sold a house
we had bought abroad)
when he left the family home he took a lot of
items from the home ( the best of everything, there was no negotiating, he
just took it, including every tool we hade aquired, was not left with 1
screw driver, screw or nail! AND ALL THE FAMILY PHOTOS
I was
looking for 30k cash equiv for the pension (or 50/50 pension share) and 60%
from the equity, total 102k, ( this would reduce my mortgage to an
affordable 110k, paying off a loan of 50k, used to by overseas prop) and
give me 30 k for a pension leaving 22k to pay of 7k car loan, 1700 bank
loan, and provide a future for my children, he is not willing to offer
more than 91k, states he has spent the 12k redundancy ( how he spent it
varies on each
ancillary relief form). his last bank statements
showed balances of up to 7k in credit at times ( this is a normal current
account, and showed withdrawals of up to 5k over a period of 5 months! my
bank balance was 1200 overdrawn!. he was in the army for about 4 years,
over 20 years ago, yet mentions this on numerous occasions on the form ( HE
WAS NO WAR HERO)
any advice appreciated as what would possibly
be awareded as fair
