my boyfriends ex has asked for 70,000 out of equitity of 70,176.00 is this reasonable?
or she moves back in the house and tries to release him from the morgatge?
she lives with her new partner of 2 years in rented accomodation after walking out of the fmh. They have two children 8 and 9
she is saying he doesnt even live in the house but resides with me which is not true apparently she has evidence! , his job takes him away from home and yes he comes to see me every other wekend and when he can and he resides at the fmh if he is not working away and has his children every other weekend.
he pays maintenance, she took family car he bought one for 800 hers is worth 4000
he has offered 50% equitity and pension
what would be fair?

Whether 50;50 is fair depends on a number of factors. However, unless he has other significant assets apart from the house, her proposal is laughable.

Proving that someone lives with someone else is actually very difficult. She may have evidence that your bf stays with you from time to time but that falls well short of cohabitation.

It sounds as if she's not being very realistic - is she using a solicitor?

well i think her asking for that is laughable and he will start at 50% and go up if need be
yes she is using a solicitor
he stays with me every other weekend
he works away from home a lot but still he pays all bills at the home and the children stay every other weekend wiith him

I suspect the judge won't see it her way at the FDR. The only real reason to give her more than 50% is to save legal expense and stress. At the moment, on the facts you've given, there isn't another reason. Even if he were living with you, given that she has a new partner, what difference would it make? I don't see why your BF's having a new partner should entitle his ex to more of the equity.
