Can I /court force my ex to sell house ?

I have a joint mrtgage which my ex is currently paying when he feels like it as part of seperation agreement which changes to suit him .I want to sell the house but he wants to keep it and wants me and son to continue to live in it.I want to rent somewhere ,a fresh start .He has held this over my head for 8 months he promised to pay but has missed at least 3 months same with two other bills he said he would pay.He has a secured loan on the house just in his name and he has told me the company will not remove the charge can I get the courts to remove charge ??

If the property is sold the secured charge will be paid off after the mortgage. If your ex does not agree to a sale it is possible to obtain a court order to force the sale although this route should be avoided if at all possible.

Your ex have no power to compel you to continue living in the property - you are your own person and can make your own financial decisions.

I was told that if the loan compant didnt agree I couldnt place the house on the market ! Just to clarify are you saying that I can put the property on market even if secured loan company has not agreed with the sale ?

I forgot to say that has is in negative equity ! but we have an iva and the iva company said they would absorb the loan into iva when house is sold
