Cost Of the Proceedings

Hi,
I am a respondent & have decided not to defend the petetioner.Both me & wife my wife have agreed on the divorce & we don't have any children & we have decided on financial matters i.e. not to take a penny from each other.

Two Questions:

1. Even though I have decided not to defend the case, I have ­object­ed to the reasons that the petetioner came up with.Is this going to be prolong the
divorce?

2. There is a question in the form asking even if i don't defend the case do I ­object­ to pay the cost of the proceedings?If so on what ground?What's the cost of the proceedings?

If you can reach agreement over grounds for divorce there will be less delay. No one sees the grounds other than the sol preparing and court staff and they see this every day.

If you agree to each pay half the costs again can be less delay.

You can disagree with the allegations but agree that the marriage has irretrievably broken down and therefore consent to divorce.

You can defend the claim for costs but if you have a diaglogue with your wife you can agree to a fixed sum contribution or to pay half of the costs. A divorce using a solicitor will codst the Petitioner between £900 and £1500 depending upon which part of the country you are in (central London = very expensive).

Depending the divorce costs can be very costly. If the petition is ­base­d upon adultery the chances are that the court will award costs in full.

Scotland here and the costs and their application here are quite different from eng/wales. There are a few good threads in the financials sections that have info and links re this topic as you will see from the one I preeviously posted. That you and ex have agreed on most with no kids etc, you should consider contacting previously stated to move matters forward.
