Thank you for that but I hope he does admit adultery and I am more than happy to at least get papers sent to the other woman. I will not divorce on anything else, so at the end of the day its adultery or nothing.

Adultery is very difficult to prove and if ex will not amdit to this you will incur additional costs...are you able to discuss grounds of divorce with him?

I hear what you're saying, but you don't divorce on adultery. The divorce is always granted "no fault". Adultery is the reason you can use to petition for divorce. It has no bearing on the finances.

If you name another person, they have to be sent papers and respond etc. If they choose not to, or contest it, the actual divorce can take a lot longer and cost more (and there's no guarantee you'll get costs).

Better to do whatever to get the divorce and use your energy and other resources sorting out a decent financial settlement.

Thank you very much for all your advice, but I will only use adultery, whatever the cost. I married for life and I do not want a divorce but I have no choice. Even though he does not want a divorce, he committed adultery, that is wrong.

Hi 50andfree, yep im with you go for adultery if you are clear in your mind that it the only way for you (but just so you know if he does not admit it could cost you if he fights it) putting that aside I would say do not name a co-respondent, pointless, thats a two horse race you're up against.... dont bother about wasting money on an old nag. sorry dont wish to sound/be flippant ... the less hurdles you give yourself the better.

Try to get him to agree to admit his Adultery on the basis you will not name her in your petition. And if he refuses, take time out and dont be bullied into anything.

Naming a co-respondent could backfire as this person might defend the suit and as adultery is almost impossible to prove, you could end up paying the co-respondent's costs. The last time I saw noe of these the co-respondent's costs were over £5k. That was 10 years ago.

Rely on adultery or unreasonable behaviour ­base­d on the inappropriate relationship but don't bother joining another party. I've yet to see a Petitioner that has gone down that route and not regretted it.
