My unqualified opinion is that filling in a C1A will greatly complicate what could be fairly straightforward contact hearing.

If you make allegations and then she does,then I think Cafcass get involved,the case gets adjourned for reports,investigations etc,and then you're looking at months of delay.

I agree with zonked who has more knowledge and I would hold fire.

Once the hearing is done with you could then pursue your concerns through the court or with social services.

That is my one concern regarding this...once the process is under way can I bring any of this to the forefront if needed, when I haven't mentioned it in the first place on the c1a form.
I am concerned that it may just look like sour grapes at that stage.
I am fairly sure she will try to say I am not fit to look after my daughter and highlight the allegation she made against me as evidence?

I think she will argue against me having contact on the basis of the allegation she made...in that I am not fit and/or a danger to my daughter and so she should not get to see me.
Not sure how far she could go with it though.

Right c100 snet in today...easier than i expected as they allow emailed documents and took card details on the phone so that they would start the ball rolling straight away...just the wait now till the 2 copies are returned to me..

When the C1A form was introduced some years ago wise voices argued that it introduced evidence into a case before the court had requested it, and that this was inflammatory and would make resolution of a case much more difficult, if not impossible. I think you were wise to hold fire.

Right, just waiting for hearing date and paperwork to be returned. Can anyone offer any advice regarding contact. I work shifs which basically mean i could have my daughter from Saturday eve till taking her to school on monday morning [week 1], the next weekend i work so cant have her then but i could have her from the monday after school till wednesday dropping her off at school [week 2] then friday eve to sunday eve the following week [week 3]. This 3 week rota would be regular, but i could also have her on other days inbetween times... what i am wondering is could there be a lot of bartering in these times, is it worth me putting in other days inbetween if for some reason some of the above is not ok with my wife? I am not going to have my daughter by the looks of things for our pre arranged half term trip home to my parents so should i ask to have her for my 2 week holiday in june at this hearing?
sure i have a few weeks to sort it all out but the better informed i am the better i will feel.

Just to add, for the 2 week holiday in June I have been offered the chance to go visit my brother in Atlanta... daughter has never met her cousins over there so a great oppertunity and he has also added that he will fund half the trip so I dont have to worry too much about costs when I have the contact and divorce stuff to worry about...my question is should I formally bring this up at my contact hearing to try to get the court to agree the holiday. I have read up on PR and taking abroad and think that as it stands at the moment my wife would not want me to take daughter even though daughter would absolutely love it, she loves flying and all the holiday stuff. If I am thinking about doing this do I need to file for some other order or can it all be covered in the contact order etc. I am hoping the court will look favourably on my application because by then [if we sort contact before June - which is no certainty] I would have missed a big chunk of my daughters life so far.
Any advice welcomed...
