Re:Can I re-list this case ?

Wrote to the court today asking for the case to be re-listed.I believe I've been patient enough and I'm not doing any more bending over backwards.
Also wrote to her solicitor informing him of my letter and pointing out he should advise her to make a new mediation appointment otherwise if we go to court without having attended mediation she will look very bad.
I think he will see it this way also.

If mediation works then either we avoid the court and get any agreement reached turned into a contact order,or we use the court hearing to do that.

Now I wait to see if the court believes this case should be re-listed.

Letter today from the court.To my surprise my case has been re-listed for directions in a 15min hearing for Feb 28th.
'The hearing can be vacated if mediation is arranged' states the court.

However she is due to give birth Feb 21st.
She will now write to the court applying to have the case adjourned for both mediation and the birth.
At least I've made a point and she now has to attend mediation.
Would be nice if the hearing did go ahead though.

I'd give anything to have yur court! The one my partner is involved with has a 14 day turn round on letters and we dont get service like that!

Good news that you have a hearing, but as you say possbly this will be adhourned due to her impending arrival, but now she may mediate as she knows your serious.
