Access to my son

Advice needed please?

I' left my wife almost a year ago, since then I have had my son to stay over on the weekends when my stbx allows it.

I miss him terribly and phone him every day for a brief conversation.

I have asked that he be allowed to stay over one night during the week and every other weekend, my ex will not allow him to stay in the week saying that this will affect his education.

My son has repeatedly asked me when he can come again and cries uncontrollably when he goes back to mum.

What is the best way of ensuring I get access to him on a structured footing, giving me access to him during holidays and the Christmas period?

There are two ways round this, one is via mediation and one is via court.
Perhaps your initial position should be to try and secure every other weekend, since there seems to be no ­object­ion to you having your son on some weekends. If midweek continues to be a sticking point you could try the approach of extending the weekend to cover pickup from school on Friday to drop off on Monday morning. You could also suggest seeing your son midweek but not overnight.
Which ever way you go, have a very clear idea on what you are going to ask for, so alternate Christmas / Easter, half of school holidays, family events (your birthday etc)

Considering the amount of contact you are getting which isnt much,I would assume the court will at least award you more or less what you are already getting.The difference is this time its 'guaranteed time'and your'll know for sure when you will see your son.
If they give you more time then you win again.It may not be on the first hearing that you get that extra time but on the 2nd then maybe a third.

Once you get your foot on the ladder so to speak regards the court then the only way is up.
