Statement of Arrangements query 1 Year, 11 Months ago
|
|
Hi,
I hope someone can help me with this.
My partner
was divorced by his ex about 6 years ago, they have a daughter who is now
7. My partner is in the forces and at the time the papers came through he
was told by his commanding officer to sign and return which he did so. He
was in Iraq at the time so obviously didn't have time to consult with a
solicitor.
His ex went to ground with their daughter and to cut
a long story short it took him 5 years to find them and to issue her with a
court order to stop her from disappearing again and for him to get access
to his daughter (which she is still refusing without giving a reason).
While I've been trying to help him with this I've found out that
his ex did not submit a Statement Of Arrangement for their daughter during
the divorce.
Can anyone tell me if this failure to complete will
have any impact at all? i.e. is their divorce valid seeing as she withheld
information and will this reflect on the upcoming court case?
Thanks for any help given either way, we just need to know as we are
planning to marry and his ex has already remarried.

yes, the divorce is valid.
Strictly, there does not have to be a
statement of information, the rules simply state that the relevent
information has to be provided to the court
